This Privacy Policy details how we will use and share the information that you provide to us. Wilson Prime Estate Agents is the data controller for the purposes of UK data protection law. This notice refers to personal data collected by us via: Our website, Email, Phone calls, Written correspondence and Social media. Our website may contain links to third-party websites. We are not responsible for their privacy practices and we encourage you to read their privacy notices.

How we collect information and why we need it

Most of the personal information we process is provided to us directly by you during correspondence, such as: giving information directly to us by filling in forms or other sections on our website, requesting information on our services, communicating with us via email, telephone, WhatsApp or written correspondence.

We use the information in order to carry out the services you require from us, such as to complete valuation appointments, viewing appointments, submit legal documents for conveyancing, keep open correspondence with the parties involved, complete financial transactions and to fulfil our lawful obligations to check identification at certain stages of the process. Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing personal data are:

  • Contractual necessity: where processing is required to provide our estate agency services
  • Legal obligation: including compliance with anti-money laundering requirements
  • Legitimate interests: such as communicating with buyers, sellers and professional advisers
  • Consent: where required for marketing communications

When we share your information

We may share personal data with trusted third parties where necessary to provide our services, including solicitors, conveyancers, anti-money laundering providers, professional advisers and IT service providers. We only share information that is necessary and require third parties to respect data protection law. 

The type of personal information we collect

We might collect and process the following information: Name, home address, postcode, email address, home and/or mobile telephone numbers, identification details, job and financial information (where required for anti-money laundering and transaction purposes), details generated by visiting our website or connecting and engaging with our social media accounts. 

How we store your personal information

We use Google Workspace to store and manage customer information. Google may process personal data on our behalf outside the UK. Where this occurs, appropriate technical safeguards are in place, including standard contractual clauses approved for use in the UK. We retain personal data only for as long as necessary for the purposes for which it was collected, including legal, regulatory and accounting requirements. In particular: Transaction and client records are normally retained for up to 6years after completion or the end of our relationship; and Anti-money laundering records are retained for 5years in line with legal requirements. Data is securely deleted or destroyed when no longer required.

Your Rights

Under data protection law, you have rights including:

  • Informed - You have the right to be informed about how and which information is collected and how we process and store this data (detailed above).
  • Access - You have the right to ask us for copies of your personal information. 
  • Rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. 
  • Erasure - You have the right to ask us to erase your personal information in certain circumstances. 
  • Restriction - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 
  • Data Portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
  • Object - You have the right to object to the processing of your personal information in certain circumstances.
  • Automated decision making- You have rights where decisions are made: Solely by automated means; With legal or significant effects.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. Anti-Money Laundering obligations may override erasure requests where applicable. Marketing objections are handled immediately.

Anti-Money Laundering Procedure

As with all estate agents we are required to collate and hold proofs of identification and addresses for all customers under the Anti-Money Laundering Regulations 2017. As an estate agency involved in residential property sales, our anti-money laundering obligations apply primarily to sellers and to buyers once an offer is accepted or a transaction proceeds. 


Customer Due Diligence

We apply a risk-based approach to anti-money laundering compliance, assessing each customer and transaction to determine the level of due diligence required. Enhanced due diligence will be applied to complex ownership structures, offshore entities, trusts, or where the ownership or source of funds cannot be easily verified. Additionally, as we are also required to establish whether there are any beneficial owners on whose behalf the transaction or activity is taking place, we would request you to identify anyone who you would consider to be a beneficial owner. Where required, we will request evidence of the source and, where relevant, destination of funds involved in the transaction.

Without this information, we will be unable to proceed with any work on your behalf. Identity and verification checks must be completed before we establish a business relationship or carry out any transaction, and before accepting an offer or progressing a sale where required by law. We will take reasonable measures to determine whether a customer or beneficial owner is a Politically Exposed Person (PEP), or a family member or known close associate of a PEP. Where this applies, enhanced due diligence is required, approval will be provided by the director of the business. If we know or suspect that a transaction involves the proceeds of crime or money laundering, we are legally required to submit a Suspicious Activity Report (SAR) to the National Crime Agency.

We are prohibited by law from informing the customer if such a report is made.

If you agree to purchase a property through us, we will also require identification and proof of address for any named purchaser. We will also require proof of where the deposit is coming from– usually in the form of an up-to-date bank statement. If any of the deposit is gifted from a third party we will require identification and proof of identification for them too.


Individual identity documents

We require one document from List A and one document from List B.

List A - Identity Document

  • Current signed passport
  • Valid UK driving licence
  • EEA member state identity card (subject to enhanced verification where required)

List B - Proof of Address

  • UK/EU/EEA Drivers Licence (if UK Drivers Licence not used as ID)
    Must be valid, not expired. Photo only. Full or provisional.
  • Bank, Building Society or Credit Union Statement
    Dated within 3 months. Must include account number and show recent activity. No general correspondence.
  • Credit Card Statement
    Dated within 3 months. Must include account number and show recent activity. No general correspondence.
  • UK, EU, EEA Mortgage statement
    Dated within 12 months. Must show the account number. No general correspondence.
  • Utility Bill
    Dated within 6 months E.g. Gas, electricity, water. Must show address for service and/or account number. No general correspondence.
  • Telephone Bill
    Dated within 6 months E.g. Landline or mobile pay monthly (excluding pay as you go). Must show address for service and/or account number. No general correspondence.
  • Council Tax
    Dated within 12 months. Must show address for service and/or account number. No general correspondence.
  • Tenancy Agreement
    Dated within 12 months. Must state full name and full property address. Issued by the local council, housing association, solicitor or reputable letting agent.
  • Benefits Entitlement Letter
    Dated within 12 months. Issued by DWP or Jobcentre plus. Must confirm benefit payable at the time of issue. E.g. Pension, disability, single parent, housing etc.
  • HMRC Tax Notification
    Dated within 6 months. Must state national insurance number and tax calculation. No general correspondence.
  • Home or Motor Insurance Certificate
    Dated within 12 months. Must state insured address or registered address for vehicle and policy number. No general correspondence.
  • UK solicitors letter confirming house purchase/land registration
    Dated within 3 months. Must state the full name of the new proprietor and full property address.
  • NHS Medical Card or letter from GP confirming registration
    Dated within 3 months. Must state the individual's date of birth and NHS number. No general correspondence.
  • Official confirmation of Electoral Register entry or official poll card
    Dated within 12 months. Must state full name and full address. No general correspondence.
  • Police Registration Certificate
    Dated within 12 months. Must state the full residential address of the individual.


Probate

We reserve the right to request alternative or additional documentation depending on individual circumstances.

If you are acting as a representative of an Estate we require the following:

  • Grant of Probate (if a will was left)
  • Letter of administration (if no will was left)
  • Individual identity evidence from List A & B for the Personal Representative, either executor or administrator


Limited company

If you are acting as a representative of a UK Company we will also require the following:

  • Certificate of Incorporation
  • Articles of Association
  • Memorandum of Association
  • Latest Annual Return or Confirmation Statement, with details of current company officers
  • If offshore, nominee director declaration and general power of attorney
  • Individual identity evidence from List A and B for all individuals or entities with 25% or more of the shares or voting rights in the company

If you are acting as a Representative of an Offshore Company we will also require the following:

  • Certificate of Incorporation
  • Articles of Association, Memorandum of Association, Latest Annual Return with details of current company officers, Share Certificate(s) showing the Ultimate Beneficial Owner OR
  • Certificate of Incumbency
  • If the shares are owned by another company, repeat the steps above for the holding company
  • Nominee director declaration and/or general Power of Attorney (if applicable)
  • Individual identity evidence from List A and B for all individuals or entities with 25% or more of the shares or voting rights in the company


Trust

If you are acting as a representative of a Trust we require the following:

  • Trust deed
  • List of trustees
  • List of beneficiaries
  • Individual Identity evidence from List A & B for all individuals with a vested interest in 25% or more of the capital and/or those who exercise control over the Trust


Records relating to customer due diligence and transactions will be retained for five years from the end of the business relationship, in accordance with the Money Laundering Regulations, and securely deleted thereafter.
